SWIETELSKY Rail CZ s.r.o. also accepts reports from persons who do not perform work or other similar activities for the company pursuant to Section 2(3)(a), (b), (h), or (i) of the Whistleblower Protection Act.

Reports may be submitted to the persons listed below who have been designated to investigate reports under the Whistleblower Protection Act, the so-called “competent persons", namely:

in writing

• ideally via the web system (see the orange link below),
• by letter (we recommend delivery by registered mail exclusively to the addressee)

orally

• via a voice message that can be recorded directly in the web system's notification form (see the link below)
• by phone between 9:00 a.m. and 4:00 p.m. on a secure phone line with an answering machine: +420 234 723 197, calls will be recorded,
• in person by prior telephone appointment

If you disclose your identity to the competent persons, they may disclose it only to other relevant persons; they may not disclose it to any other person without your written consent, except in cases where the relevant person is required by law to provide information about your identity to public authorities.

The competent persons are, in particular, required to address your report – that is, to assess whether it constitutes a report under the Whistleblower Protection Act or to evaluate its merits – and to notify you within the prescribed time limits of the outcome of the investigation and, where applicable, of any corrective measures taken. The duty of confidentiality applies not only to your identity but also to any other information from which your identity or that of other persons protected by the Whistleblower Protection Act could be directly or indirectly determined.

Reports may also be submitted anonymously, without disclosing your identity. In such a case, the competent persons will inform you of the outcome of the investigation only if the report was submitted via the web system to a secure mailbox. The protection of your identity and the obligation to notify you under the Whistleblower Protection Act will apply to you at the moment your identity is revealed during the investigation of your anonymous report.

If, as a whistleblower, you file a knowingly false report, you may be committing an offense and face a fine of up to 50,000 CZK. Additionally, if you are an employee, you may also face disciplinary action.

All whistleblowers, especially if they are dissatisfied with how their report was handled within the internal reporting system, may in any case also contact the Ministry of Justice, as the so-called external reporting system (email / tel.: +420 221 997 840).
